In January, we provided an update on fuel and oil tank regulations in Kern County that explained the new regulations, what they mean to you, and our recommendations. Greg’s Petroleum representatives have since attended a meeting between the Kern County Farm Bureau, Kern County Fire Department, and Kern County Environmental Health to better understand the emphasis of the regulations.

First of all, so called “gravity feed tanks” are at the top of the list for enforcement of regulations going forward. These tanks are placed on a metal stand above the filling height of equipment, so that fuel or lubricants will flow out of the hose using gravity with no pump required. Unfortunately, this type of tank is at risk of tipping over in an earthquake, creating a hazardous situation. Gravity feed tanks are no longer allowed and we expect this regulation to be enforced on a regular basis going forward. What that means is if the Kern County Fire Department visits your facility and sees a gravity feed tank, you will likely be cited. To prevent this, we recommend getting gravity feed tanks pulled off their stands, put into containment, and retrofitted with a pump. Make sure electric wiring is done correctly and ensure there are no leaks in the tank.

In addition, when developing a plan for tank compliance, consider whether your tanks are in a populated area. If your tanks are within city limits, often have many people around them, or are close to buildings, they will likely be high priority for enforcement of the UL 2085 standard for fuel and the UL 142 standard for oil. However, keep in mind this doesn’t mean tanks in isolated locations are exempt. They are just less likely to receive focus right now.

Lastly, mobile tanks must be properly permitted as well. Any tank that is attached to a trailer or vehicle is required to meet Department of Transportation standards. If you have a noncompliant tank on the road, for example a repurposed tank that is strapped to a trailer, you are at risk of being cited.
